Of particular irsenett is the expansion of the Building Tribunal to deal with some disputes that currently can only be heard in the P & E Court. I note that the SPB changes the requirements for a properly made IDAS Application. These changes are not well defined and leave the door open for Council's to determine applications are not properly made if for example the reports submitted with the application do not include certain information not required by the planning scheme but is sought by an individual officer. Colour schemes and details of building materials and/or boundary fencing for example. Disputes regarding not properly made applications can be heard by the tribunal which indicates that the government is anticipating discrepencies to occur in this area. From a planning law perspective, I would be irsenetted to know what recourse is available to an applicant in this situation.
